Before trying to immigrate to any country and pushing the requirement for a passport, you must carefully study the citizenship legislation in force at the time of arrival. Depending on the path chosen, it will be possible to draw up documents. You can often come across a request on how to obtain Luxembourg citizenship, much less people who were able to go this way to the end.

The policy of the Duchy of Luxembourg in the field of admission to citizenship is quite tough, due to the tiny size of the country, the peculiarities of the political system and economy, they are not very loyal to potential applicants for citizenship. Those who dream of getting a Luxembourg passport will have to work hard for this.

How to obtain Luxembourg citizenship by law?

In terms of obtaining citizenship of the duchy, the country's legislation is not too different from its neighbors and from world practice, the same grounds apply: the right to blood; the right of the soil, although, rather, it is necessary to translate as the right of the earth; adoption; naturalization. The last mentioned method of obtaining Luxembourg citizenship is, in fact, the only possible one for the majority of potential applicants.

The right of blood is the recognition of a child as a citizen of the Duchy of Luxembourg, if both parents, or one (father, mother) are citizens of this dwarf state. The right of the soil acts selectively: the fact of birth on the territory of the country does not automatically give rise to Luxembourg citizenship. The citizenship of the parents is taken into account:

  • both parents are nationals of another state - the child does not acquire Luxembourg citizenship;
  • both parents - stateless, stateless - the newborn receives Luxembourgish citizenship;
  • a child, about whose parents nothing is known, automatically becomes a subject of the duchy.

There are two legal ways for foreign citizens to become citizens of the Duchy of Luxembourg by being adopted or by naturalization. For adult potential applicants, the last method on the list is the first and only one.

Naturalization as a path to Luxembourgish citizenship

The first requirement that must be fulfilled is the "residency requirement", the Luxembourg legislation in this regard is quite strict - at least 10 years of residence (after receiving a document of permanent residence). The residence permit may be reduced for certain categories of applicants, for example, the period of residence for the following persons is reduced to five years: born in the territory of the duchy; officially recognized as refugees; stateless; deprived of citizenship for any reason; widowers who were previously married to a Luxembourg citizen; divorced from a Luxembourg citizen. The latter condition will apply if a divorced couple has two or more common children, while at least one of them lives within the territory of the duchy.

In addition to the age of majority and the residency requirement, the submission of documents requires the fulfillment of other conditions set forth by the Luxembourg citizenship law. Assimilation into a social society is very important for a potential job seeker. When checking the submitted documents, the place of work and knowledge of the language, knowledge of history and traditions will be taken into account.

There is also another, alternative way of obtaining citizenship in Luxembourg by naturalization. It is based on the applicant's ties with the state and its inhabitants. For example, adopted children, born in the territory of the duchy, who have entered into legal marriage with a citizen of the country, have certain benefits. This category of applicants for citizenship writes an application addressed to the Minister of Justice of Luxembourg, indicating the reasons for the "alternative" naturalization. To obtain citizenship, the approval of the head of the ministry is enough.

Other features of obtaining and losing citizenship

Luxembourg legislation is in the position of denying dual citizenship. The exception is children who are born to citizens of the duchy, but outside the country. They can obtain citizenship at the place of birth, in connection with the laws in force in the territory of another state. This situation persists until the child turns eighteen years old. At this age, he must make an independent decision, choose either the citizenship of the country at the place of birth, or the citizenship of the Duchy of Luxembourg and abandon the former.

The loss of Luxembourg citizenship can be on a voluntary basis, when a person renounces citizenship himself, or on an involuntary basis for various reasons. Among them - obtaining the rights of a citizen of another country, committing a crime (applies to naturalized citizens).
